Terms of the Agreement
The landlord has the right to inspect the premises without prior notice at any time to enforce violate any of the terms of this agreement, the rental shall be terminated immediately. The tenant shall waive the rights to process if they fail to vacate the premises at the expiration time and date of this vacate the premises upon termination of the rental agreement. The tenants shall vacate the agreement. By signing this agreement, tenant agrees to adhere to all terms below:
1. Smoking of any products, is not permitted. This includes tobacco, Vapor products, cigars, or cannabis products of any kind, Smoking is permitted only in designated outdoor smoking areas as allowed by condominium or property owner guidelines. If it is determined that a guest has been smoking in the rental property at any time during their stay, a fee of $500 WILL be charged immediately, and the guest WILL be asked to vacate the property without a refund.
2. People other than those in Guest Party may not stay overnight in the property. Any other person in the property is the SOLE responsibility of the Guest. Guests are NOT allowed to exceed the occupancy limit of the property as described in the rental marketing. If it is found that additional people are staying in the property without express permission from Saint Augustine Vacation Rentals, ALL occupants, including those who rented the property, will be required to vacate the property immediately, without refund.
3. Guests should not create excessive noise at a level that disturbs neighbors. Code enforced quiet hours are between 10:00 pm and 8:00 am.
4. All rental units are privately owned; the owners are not responsible for any accidents, injuries or illness that occurs on the premises or its facilities. The Homeowners are not responsible for the loss of any personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises, or others they invite to use the premise.
5. Keep the property and all furnishings in good order.
6. Only use appliances for their intended uses.
7. Pets are NOT allowed unless expressly approved by the owner, and with applicable retroactively charged to guest if it is determined by housekeeping that a pet was in the property, additional fees will be charged to insure the home is properly cleansed of all allergens.
8. PARKING: Parking passes, if needed, will be in your rental packet. Please leave the parking passes in the rental unit when you leave. Park in designated spaces only. (In general, a condo with reserved parking will have one guest parking space per unit, ALL other vehicles MUST be parked in guest parking or risk being towed at the guests’ expense.) Do not park on the street in the case of rental homes, use the driveway only.
9. HOUSEKEEPING: There is no daily housekeeping service. While linens and towels included in the rental rate. We suggest you bring beach towels. We do not permit towels or linens to be removed from the rental properties at any time. For stays longer than one-week, additional housekeeping services may be requested for an additional charge.
10. GARBAGE: Any garbage must be stowed in the proper garbage or recycling receptacle, either in the receptacles provided at homes or as required by condominium rules and regulations. or as required by condominium rules and regulations.
11. HOT TUB: No children under the age of 18 may use the hot tub at any time. (without adult supervision). When using the hot tub, remember that there is a certain health risk associated with this facility. Use at your own risk. Our housekeepers drain, sanitize, refill and replenish chemicals in all tubs prior to your arrival; therefore, it may not be warm until later in the evening. DO NOT STAND ON HOT TUB COVERS. Hot tub covers are for insulation purposes only and are not designed to support a person or persons. They will be damaged, and the guest will be charged for full cost of replacement. Remember, when not in use, replace cover on hot tub to keep it warm.
12. Septic system. Some homes are on septic systems. (not condos.) The septic systems are very effective however, they WILL become clogged if improper materials are flushed. DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at any time. If it is found that the system has been clogged by feminine products, the Guest will be charged for service call.
13. STORMS: If there is a storm or hurricane, no refunds are given unless:
State or local authorities order mandatory evacuations in a “Tropical Storm/Hurricane Warning Area”
A mandatory evacuation order has been given for the Tropical Storm/Hurricane Warning area of residence of a vacationing guest.
The day that the authorities order a mandatory evacuation order in a “Tropical Storm/Hurricane Warning Area” we will refund:
Any unused portion of rent from a guest currently registered; – Any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten the stay, to come in after the Hurricane Warning is lifted.
Any advance rents collected or deposited for a reservation that is scheduled to arrive during the “Hurricane Warning” period.
14. The tenants and tenants’ guests shall hereby indemnify and hold harmless the landlord and property owner against any and all claims of personal injury or property damage or loss arising from use of the premises regardless of the nature of the accident, injury or loss. Tenants expressly recognize that any insurance for property damage or loss which the property owner may maintain on the property does not cover the personal property of tenants, and that the tenant should purchase their own insurance for tenants and guests if such coverage is desired.
15. Tenants agree to pay all reasonable costs, attorneys’ fees and expenses that shall be made or incurred by the property owner enforcing this agreement.
16. Tenants expressly acknowledge and agree that this agreement is for transient occupancy of the property, and that tenants do not intend to make the property a residence or household.
17. We occasionally experience outages that are beyond our control. Outages are reported as they occur. No refunds are given for outages.
18. There are no refunds for shortened stays or ruined expectations due to weather.
19. If the property is, or goes on the MARKET FOR SALE, it may be shown to qualified buyers during the tenants stay. Every effort is made to schedule a showing at a convenient time as to not interrupt the tenants’ vacation.
20. It is the tenants’ responsibility to learn about safety precautions, heed warning signs of water conditions, and safety procedures concerning swimming or being around the pool. Tenant is hereby notified that the pool can be hazardous, and tenant accepts fully the risks involved. Tenant is further notified to be cautious when exiting any home where the pool is open, and in close proximity to the entry ways which be a hazard. There may be no rails to prevent a fall into the pool. (if applicable)
21. Only legally owned and acceptable firearms shall be permitted on the premises according to state and local laws.
22. Tenant agrees that fireworks and other hazardous materials shall not be used in or around the property.
23. Tenant shall use the property for legal purposes only, and other use, such as but not limited to illegal drug use, abuse of any person, harboring of fugitives, etc.; shall cause termination of this agreement with no refunds of rent or deposits.
24. Tenant agrees not to access the “owners’ closet”, even if unlocked, which may contain personal property, cleaning supplies, etc.
25. The property has a fire extinguisher near the kitchen area and was fully charged when last inspected. It is the duty of the tenant to inform the property manager immediately if the extinguisher becomes less than fully charged. Tenant agrees to use the fire extinguisher only for emergencies.
26. The property has smoke detectors installed and are believed to function properly at the time of rental. Tenant will notify management without delay if a smoke detector chirps or has a low battery condition.
27. Tenant is advised that there is no carbon monoxide detector on the property and accepts the risk of not having one.
28. Tenant shall see to their own security while on the property by locking doors, windows, garage doors, etc. when it’s prudent to do so.
29. Valuable items left behind by the tenant will be held for the tenant and every reasonable effort will be made to contact the tenant for return. If items are not claimed within 30 days, they shall become the property of the landlord. The landlord shall not be held liable for condition of said items. ($25minimum return fee plus actual shipping cost.)
30. Cable TV, internet and phone are provided, and service levels chosen by the property owner. No refund of rents shall be given for outages, content, lack of content, or personal preferences with regards to these services.
31. Tenant agrees that air conditioning shall not be set below 72 degrees and that heat shall not be set above 78 degrees. And that the fan setting shall be “auto”. Doors and windows shall be closed when either heat or air conditioning is in operation.
32. Return check fee is $75.00
33. Lock out fee will range from $50.00 to $125.00
34. Check in time is 3:00 PM. IF you CANNOT make it to our office by 3:00PM, you MUST call us. Check out time is 10:00 AM, housekeeping will arrive between 10:15 and 10:30 to begin cleaning the property.
35. First Choice Florida Realty reserves the right to rent only to those adults 25 years and older.
36. If a rental unit becomes unavailable for any reason, including removal by owner from our rental program, guest shall hold Saint Augustine Vacation Rentals, LLC. harmless. We will make every effort to place the guest in comparable accommodations, when available. If comparable property is not available, agent may refund entire deposit to guest.
37. There are no refunds due to shortened stays or ruined expectations due to work or family emergencies or other commitments.
